These AI Wizora Terms of Use (hereinafter referred to as the “Terms”) are addressed to an indefinite group of individuals who use AI Wizora features.

These Terms are an integral part of the Datawiz Terms of Use and Datawiz Privacy Policy. By using AI Wizora, you unconditionally agree to these Terms, as well as the Datawiz Terms of Use and Datawiz Privacy Policy.

AI Wizora uses artificial intelligence models from third-party providers, which are made available to you through the AI Wizora interface. AI Wizora may, at its sole discretion, add, remove, restrict, or otherwise modify the third-party providers included in AI Wizora's services at any time without additional notice. If you decide to use AI Wizora, you must do so in a manner that is fully compliant with the policies of any third-party provider whose services you use. These policies are not set or controlled by AI Wizora, and you are solely responsible for reviewing them. By using AI Wizora, you unconditionally agree to the terms and conditions of service provided by Anthropic and OpenAI.

If you do not agree to these Terms, you must immediately stop using AI Wizora.

1. Definitions.

1.1. “AI Wizora” is a virtual assistant that functions on the basis of artificial intelligence technologies based on artificial intelligence models (including GPT-4o, Claude 4 Sonnet), integrated into the Datawiz platform to improve data analytics. Datawiz has the right to change the functionality of AI Wizora at any time without your prior consent (including, but not limited to, reducing/increasing the number of requests, changing AI models, etc.).

Disclaimer regarding results. All answers generated by AI Wizora are not guaranteed to be accurate. You agree to independently verify their accuracy before making any decisions based on them.

Disclaimer regarding the BETA version: AI Wizora is currently an experimental feature provided for testing purposes. Its functionality may change or be temporarily suspended without prior notice.

1.2. “Input data” means any information, data, queries, files, and content that you submit to AI Wizora.

1.3. “Output data” means information, data, files, and content generated by AI Wizora in response to receiving your Input data.

1.4. “Platform” means any paid or free services provided by Datawiz in which AI Wizora can be used.

1.5. “Website” means the datawiz.io website and any derivative pages.

2. Using the AI Wizora service.

2.1. You can use AI Wizora by formulating your query and entering Input Data into AI Wizora.

2.2. You are allowed to make no more than 50 queries per day. In order to optimize the load or develop functionality, Datawiz has the right to change (decrease/increase) the number of queries per day.

2.3. AI Wizora may, at its sole discretion, provide you with the technical ability to connect your personal account of a third-party supported artificial intelligence system (GPT-4o, Claude 4 Sonnet, etc.) to AI Wizora. In this case, the maximum number of requests may be increased, provided that your account allows for a larger number of requests.

2.4. AI Wizora transmits the Input Data and the content of the request to the involved artificial intelligence service for processing in real time.

2.5. Your request is processed instantly (except for technical malfunctions or restrictions); the processing time of the request depends on the complexity of the request structure. Your request is not stored on artificial intelligence services, but Datawiz is not responsible and cannot be held responsible for the operation of these services.

2.6. Your request and the content of the conversation with a third-party artificial intelligence service exist during the current session (session memory) and are automatically deleted from such a service after the session ends; at the same time, Datawiz is not responsible and cannot be held responsible for the storage or deletion of data on such services.

2.7. Your request and the content of the conversation with the artificial intelligence service involved (chat history) may be stored on Datawiz servers and displayed at your request (if AI Wizora has the corresponding functionality).

2.8. Each of your requests is processed independently.

2.9. AI Wizora only processes requests that are available through AI Wizora functionality.

2.10. After processing your request, AI Wizora formulates a response containing the Output Data.

2.11. You can evaluate the quality of responses (if technically possible) in order to help developers improve AI Wizora functionality.

2.12. You are strictly prohibited from:

2.12.1. Using AI Wizora outside the Datawiz Platform or its affiliates.

2.12.2. Develop products and services that compete with AI Wizora.

2.12.3. Circumvent technical restrictions.

2.12.4. Use AI Wizora to create illegal or offensive content, or content that violates the rights of third parties.

3. Intellectual Property

3.1. Intellectual Property Rights to AI Wizora.

3.1.1. All intellectual property rights to AI Wizora belong to Datawiz or the relevant rights holders who have granted permission to Datawiz.

3.1.2. In any case, you are not transferred any intellectual property rights to AI Wizora. You have the right to use AI Wizora solely for the purpose of receiving services. The right to use AI Wizora means that you are granted a non-exclusive, revocable license, without the right to transfer to third parties, to use AI Wizora within the limits of its available functionality and in accordance with its functional purpose. Such a license is valid for the paid period and may be unilaterally revoked by Datawiz.

3.1.3. All rights to AI Wizora are protected in accordance with applicable intellectual property laws and intellectual property laws worldwide.

3.1.4. You may not, without the prior written permission of Datawiz, in any way copy, distribute, moderate, edit, modify, alter the functionality, decompile, request the internal structure of the service, transfer to third parties, or otherwise illegally use AI Wizora (and its components) in any way, except in cases where such actions are openly and explicitly permitted by the functionality of AI Wizora.

3.1.5. You are obliged to immediately cease any infringement of Datawiz's copyright upon request by Datawiz.

4. Input and Output Data

4.1. “Input Data” means any information, data, queries, files, and content that you submit to AI Wizora.

4.2. By uploading or entering Input Data to AI Wizora, you confirm that:

4.2.1. You have the full right to provide such data for processing.

4.2.2. You allow the artificial intelligence model to analyze, process, and use the information provided (including customer data or commercial data) solely for the purpose of generating responses and potentially improving the performance of AI Wizora.

4.2.3. You understand that the data may be temporarily stored in an isolated environment, but it is not used to train the general AI model.

4.3. Intellectual property rights to your content.

4.3.1. All intellectual property rights to the content you upload to AI Wizora (Input Data) must belong solely to you.

4.3.2. By uploading content to AI Wizora, you confirm that you have the right to use the relevant content (including intellectual property rights, licenses, permissions, trademarks, etc.) and that it does not infringe on the intellectual property rights of third parties in any way.

4.3.3. By uploading content to AI Wizora, you automatically grant Datawiz a valid, worldwide (territorially unlimited), irrevocable, non-exclusive right to collect, process, use, display, copy, duplicate, reproduce, and edit the relevant content. These rights are granted for the purpose of providing services. These rights are granted by you free of charge (without payment of remuneration to you) and without the formalization of an act of acceptance and transfer of rights.

4.3.4. Datawiz has the right to delete your content if such content infringes the intellectual property rights of third parties or if you have not provided proof of ownership of the relevant rights to the content, as well as if such content violates the law or morality.

4.4. “Output Data” is information, data, files, and content generated by AI Wizora in response to receiving your Input Data.

4.4.1. Datawiz has the right to use the content you create in AI Wizora for the purpose of providing you with services or improving the functionality of AI Wizora.

4.4.2. By downloading generated content from AI Wizora, you automatically grant Datawiz a valid, universal (territorially unlimited), irrevocable, non-exclusive right to collect, process, use, display, copy, duplicate, reproduce, and edit the relevant content. These rights are granted for the purpose of providing you with services. These rights are granted by you free of charge (without payment of remuneration to you) and without the formalization of an act of acceptance and transfer of rights.

5. Payment

5.1. Service prices and payment procedure.

5.1.1. AI Wizora is a paid service. The price for using AI Wizora is posted in the relevant sections of the Website, in the payment sections, or is communicated to you directly before payment.

Disclaimer: Datawiz has the right, at its sole discretion, to provide you with AI Wizora for temporary free use for the purpose of testing and determining the functionality of AI Wizora.

5.1.2. Payment for the use of AI Wizora is made in non-cash form using one of the methods available on the Website: payment via payment systems (Fondy, LiqPay, Wayforpay, Privat24, Apple Pay, Google Pay, Visa Checkout, Masterpass, etc.) or payment to a current account (by agreement) or in any other agreed manner.

5.1.3. By making a payment through an electronic payment system, you confirm that you are familiar with the terms and conditions of the relevant system.

5.1.4. You may be charged a commission for making a payment in accordance with the rates set by the banking institution or electronic payment system.

5.1.5. Payment for the use of AI Wizora is made exclusively by 100% prepayment.

5.1.6. Payment is considered fulfilled by you from the moment we receive confirmation from the banking institution or electronic payment system that the payment has been credited to our current account.

5.2. Price changes.

5.2.1. Datawiz has the right to change the prices for the use of AI Wizora at any time without additional notice.

5.2.2. Prices for services for the already paid period are not subject to change.

5.3. Discounts, promo codes, and promotions.

5.3.1. Datawiz has the right, from time to time, to offer various discounts and promotions, as well as to issue promo codes that give a discount on prices.

5.3.2. Datawiz will notify you of the introduction of discounts, promo codes, and promotions by any available means.

5.3.3. Datawiz independently chooses the terms, duration, and procedure for providing discounts, promo codes, and promotions.

5.4. Refunds.

5.4.1. Since you get access to AI Wizora at the time of payment, no refunds are provided.

5.4.2. You are solely responsible for your use or non-use of AI Wizora. In case of non-use of AI Wizora (full or partial), you are not entitled to a refund of the funds paid.

6. Liability.

6.1. Datawiz shall under no circumstances be liable for:

6.2.1. Any direct or indirect losses incurred by the user, including loss of profits, income, or inability to obtain expected income, etc., arising from the use of AI Wizora.

6.2.2. The content of AI Wizora not meeting any of the user's expectations.

6.2.3. Decisions made by you and/or any third parties based on information obtained while using AI Wizora.

6.2.4. Malfunctions in the operation of AI Wizora caused by technical disruptions in the operation of servers, equipment, software, etc. AI Wizora may be temporarily, partially, or completely unavailable due to maintenance or any other technical reasons without notice and without compensation for damages.

6.2.5. Your use and posting of Input Data in AI Wizora. In the event of a claim or lawsuit by third parties regarding the infringement of intellectual property rights in such materials, you are obliged to compensate Datawiz for losses and material damage.

6.2.6. For the operation of third-party services on which AI Wizora operates, including the operation of third-party artificial intelligence services.

6.3. In any case, Datawiz's total liability for any claims and/or complaints may not exceed the amount of payment made by you in the current month.

6.4. Datawiz makes no guarantees regarding the results that may be obtained from using AI Wizora. You understand and agree that any content or Output obtained through the use of AI Wizora is provided “as is” and is obtained at your own risk. You assume the risks of not making a profit and the risks of possible losses associated with the use of information obtained while using the AI Wizora Service.

AI Wizora is provided “as is,” without any warranties or conditions. In particular, you should understand that AI Wizora may malfunction or contain errors. We make no warranties, either express or implied, regarding the absence of malfunctions or errors.

6.5. In the event of your violation of these Terms and/or any other terms posted in the relevant sections of the website, Datawiz has the right to terminate and/or restrict your access to AI Wizora (including terminating access to the service) without refunding the funds paid.

6.6. You are liable for any violations committed by you that cause damage to Datawiz, including the amount of damage caused, losses incurred, and lost profits.

6.7. In the event that we engage persons providing legal and judicial assistance to protect our violated rights, you are obliged to compensate for the costs of legal assistance, as well as court fees, payments, commissions, translation costs, etc. Compensation shall be paid if your guilt in the violation is proven.

7. Termination of use of AI Wizora.

7.1. Datawiz may immediately suspend or restrict your access to AI Wizora without refunding any fees paid in the following cases:

7.1.1. You have violated these Terms.

7.1.2. You have not paid for AI Wizora.

7.1.3. You pose a risk to the security, data privacy, or intellectual property of AI Wizora, Datawiz, or third parties.

7.2. Datawiz will notify you of the suspension or restriction of access to AI Wizora by any means available.

8. Final provisions

8.1. Applicable law.

8.1.1. These terms are governed by and construed in accordance with the laws of Ukraine. Any issues not covered by these terms shall be resolved in accordance with the applicable laws of Ukraine.

8.1.2. Considering that AI Wizora was created to provide services to entrepreneurs, enterprises, institutions, and organizations, you understand and agree that AI Wizora is directly related to your business activities. AI Wizora is not intended to meet your personal needs that are not related to business activities. In this regard, the relationship between Datawiz and you is not subject to consumer protection laws.

8.1.3. If any provision of these Terms is found by a court to be invalid, it shall not affect the validity or enforceability of the remaining provisions of these Terms.

8.2. Dispute Resolution.

8.2.1. The pre-trial procedure for resolving disputes regarding claims against Datawiz is mandatory. The term for considering a claim is 60 (sixty) days from the date of its receipt by Datawiz.

8.2.2. The pre-trial procedure for resolving disputes regarding Datawiz's claims against you is not mandatory.

8.2.3. If disputes and disagreements cannot be resolved through negotiations, such disputes and disagreements shall be considered in the appropriate court at the location of the defendant.

8.3. Changes to the Terms.

8.3.1. These Terms may be changed by Datawiz unilaterally without additional notice. The new version of the Terms shall come into force from the moment it is posted on the Website.

8.3.2. By using AI Wizora, you confirm your agreement with the new terms of the Terms in the version in force at the time of your use of AI Wizora.
