1. GENERAL PROVISIONS
1.1. This Privacy Policy (hereinafter referred to as the Policy) regulates the procedure for processing information and personal data of the User collected through the Website and services of the Company (hereinafter referred to as the Service).
1.2. This Privacy Policy is an integral part of the Terms of Use.
1.3. The terms in this Privacy Policy are used in accordance with the Terms of Use, unless otherwise specified in the Policy itself.
1.4. The information and personal data of Users are processed by Datawiz Ukraine Limited Liability Company, a legal entity registered and operating under the laws of Ukraine, legal entity identification code 40425206 (hereinafter referred to as the Company). The Company is the owner of the information and personal data of the Users.
1.5. In addition to the Company, the managers of the Users' information and personal data are also:

Datawiz Inc., a legal entity registered and operating under the laws of the United States of America (Delaware), address: 1811 Silverside Road, Wilmington, Delaware 19810, United States.
1.6. By using the Website and/or the Service, the User automatically agrees to the terms of this Privacy Policy, including the AI WIZORA Terms of Use.
2. INFORMATION PROCESSED BY THE COMPANY
2.1. When interacting with the User, the Company processes the following information:
2.1.1. Personal data:
- last name, first name, patronymic; company or legal entity name; place of residence and registration, email address, contact phone number, other contact information; IP addresses, other User communication data; logins, passwords; bank details; identification and tax number; date and year of birth; age, gender, social status.
2.1.2. Commercial information:
- information and data of a professional, production, business, organizational, commercial, and other nature, including: information about goods, their quantity and types, prices for goods.
- information contained in databases, reports, analytical materials, statements, diagrams, graphs, specifications, tables; information relating to agreements, contracts, and other legal transactions, pricing of goods and services; information containing commercial and banking secrets; business plans and business development strategies.
- photographic images of goods, employees, partners, office premises, trademarks, etc.
- information about suppliers and buyers; information about production equipment; information about methods of purchasing and selling goods; information about types of activities; information about equipment used in the business process, the quantity and cost of inventories; information about balances and bank account statuses; information about income levels; information about procurement, sales, and investment plans.
- information about management methods and tools; information about the internal structure of the enterprise; information about the effectiveness of core activities, production capabilities, development plans, expansion plans, investment plans, procurement and sales plans, and other commercial plans; information about management methods, planning, and control systems.
- Service metadata (including AI Wizora): request time, request type, request content, request result, response quality assessment, session identifiers.
- any other information that may constitute commercial information.
3. USE OF INFORMATION
3.1. By disclosing information, the User gives the Company his/her consent to process the User's information (including: collection, storage, systematization, modification, deletion, use, distribution, depersonalization, blocking).
3.2. The User's personal information may be processed by the Company for the following purposes:
3.2.1. To provide the User with Services, including providing access to the Service.
3.2.2. To ensure the security and functioning of the Website and the Service; to administer the Website and the Service, including for internal operations, such as troubleshooting, data analysis, testing, and conducting surveys etc.
3.2.3. To inform the User about new types of Services, changes in the cost of Services, news, promotions, advertising campaigns, informational messages, etc.
3.2.4. To carry out marketing activities, place advertisements, including through Google Ads and similar resources; to analyze the User's behavior and preferences.
3.2.5. To provide feedback and communicate with the User.
3.2.6. To interact with payment services.
3.2.7. To respond to requests from law enforcement and other government agencies.
3.3. The User's commercial information is processed by the Company in order to enable the User to use the functional capabilities of the Service, as well as to process statistical data without disclosing the content of commercial information.
3.4. The Company has the right to transfer the User's information to other entities, namely:
3.4.1. Employees, contractors, legal and tax consultants; entities that provide accounting, marketing, advertising, and IT services, etc. – for the proper provision of services to the User.
3.4.2. Courts, law enforcement agencies, government agencies – in the event of the fulfillment of any legal obligations, including in connection with a court decision.
3.4.3. Its successors – in the event of acquisition or merger, financing, corporate reorganization, creation of a joint venture, sale of the Company's assets.
3.4.4. Payment and banking systems – for the proper payment by the User for the Company's Services.
3.4.5. Third-party artificial intelligence services, including for the purpose of the User's use of such services, including those integrated into the Company's Services (AI Wizora, etc.).
3.5. The User is informed and agrees that telephone conversations (including conversations via messengers, etc.) with the Company or its representative may be recorded for the purpose of monitoring the quality of the work of the Company and/or its representative(s).
3.6. The Company has the right to send advertising messages to the User, promote the Company's services, informational materials, promotions, sweepstakes, etc., including by telephone, email, SMS messages, messages via messengers, etc. The User has the right to opt out of such messaging at any time by sending a corresponding message to the Company. Withdrawal of the User's consent to receive advertising messages does not result in the Company's refusal to provide services to the User.
3.7. The Company stores User information for the period necessary to achieve the purposes for which the information was collected. To determine the appropriate storage period, the Company takes into account the volume, nature, and sensitivity of personal data, the potential risk of harm from unauthorized use or disclosure of personal data, and the purposes for which the Company processes personal data.
3.8. For the purpose of high-quality and reliable data storage, User information may be stored on various local servers, including foreign servers and servers of the Company's subcontractors.
3.9. The Company makes every effort to preserve personal data and prevent its loss.
3.10. The Company is not responsible for the loss of personal data in the event of a hacker attack, software hacking, illegal actions of third parties, unlawful actions of the User, and actions of the User that violate the terms of the Privacy Policy or Terms of Use.
3.11. As a result of a failure, technical malfunction, actions of third parties, including, but not limited to, a virus or hacker attack, the User's data may become available to third parties. The User is aware of this and undertakes not to make any claims against the Company for compensation for losses (damages) arising in connection with this.
3.12. When processing the User's personal data, the Company is guided by and complies with the requirements of current legislation on the protection of personal data.
3.13. By using the Website or the Service, the User grants the Company the right to refer to the User as its client in advertising, marketing campaigns, etc.
4. COOKIES
4.1. The Website uses cookies. For the Website to function properly, it collects cookies—small text files that store information about the User's interaction with the Website's features and individual interface settings. The server automatically accesses them during each visit by the User. They are generated by the browser and stored directly on the computer, tablet, or phone. Because of them, the User does not have to repeat the authorization process during the next visit, for example.
4.2. If consent to the use of cookies is not given or the User rejects their consent, the use of the Website may be partially or completely disabled for the User.
4.3. The Company uses persistent and session cookies.
4.4. Persistent files are updated after the User's visit. They may include “third-party cookies” placed by third-party websites. To optimize the service, improve the quality of services, and for commercial purposes, the right to collect and process the information contained in cookies may be granted to analysts, optimizers, and advertising agencies. The data they collect is subject to disclosure in accordance with their privacy policy provisions.
4.5. Session cookies are automatically deleted after the session ends and the browser is closed.
4.6. Cookies are divided into four types according to their purpose:
- Mandatory;
- Functional;
- Analytical;
- Targeted.
4.7. Mandatory cookies are used to speed up the work with the Website; therefore, they collect basic information about the User's interaction with the resource. For example, data for filling in the authorization field.
4.8. Functional cookies are designed to optimize the workflow: they store information about the language, location, and specific settings selected.
4.9. Analytical cookies process information about the User's behavior: how many times the User has visited the Website, how long the session lasts, how many pages are opened during the session. Such information is needed solely to improve the interface in accordance with the User's preferences, to make access to popular and important pages as simple and fast as possible.
4.10. Targeted cookies collect information that helps to tailor relevant advertising and evaluate the effectiveness of current campaigns. Thanks to them, the User sees only useful advertising blocks on the pages. They can be transferred to advertisers to improve their service.
4.11. In the User's browser settings, it is possible to disable cookies and delete saved text documents. If the User does so, some features of the site may become unavailable to them.
5. WITHDRAWAL OF CONSENT TO PROCESSING OF INFORMATION
5.1. Withdrawal of consent to the processing of information (fully or partially) may be carried out by the User sending a corresponding notification to the Company's address specified in the contact details of this Policy.
5.2. In doing so, the User agrees that such a letter of withdrawal may have negative consequences for him, namely: the Company's refusal to provide Services (including termination of access to the Service) due to the impossibility of performing them without the specified data. In this case, the funds paid by the User will not be refunded by the Company.
6. CHANGES TO THE PRIVACY POLICY
6.1. This Privacy Policy may be changed by the Company unilaterally, without notifying the User. The new version of the Privacy Policy shall come into force from the moment it is posted on the Website.
6.2. By using the Website or the Service, the User confirms their agreement with the new terms of the Privacy Policy in the version in force at the time of the User's use of the Website or the Service.
